Kirk files suit for estate in crash that killed Inez couple

FRANKLIN, W.Va. — It was a very wet and rainy day on June 1 when Virgil Perry and Sharon Newsome, parents of Marilyn Perry, age 19, LeRoy Perry, age 17, Elizabeth Perry, age 15, and Virgil Perry, Jr., age 13, traveled east on 1-78 in Lehigh County, Pa., in a tractor-trailer owned by Perry Trucking Company of Franklin, W.Va, a company allegedly owned by Jimmy Perry, a company for which Virgil Perry worked as a driver.

According to a lawsuit filed in the Franklin Circuit Court against Perry Trucking Company by Kirk Law Firm, Sharon Newsome was a passenger in the truck that was operated by Virgil Perry. The suit further states that Mr. Perry “in attempting to negotiate a left hand turn, lost control of the vehicle which he was driving, striking the center median barrier and then a bridge support, causing a fiery collision that resulted in the loss of his own life and that of Mrs. Newsome.”

Further, the suit alleges, “Sharon Newsome endured mental stress, anguish, loss of probable lifetime earnings and pain and suffering as a result of this crash, and her

Estate has incurred medical and funeral expenses as well as pecuniary losses, including loss of economic support that Ms. Newsome would have provided to her children” and the lawsuit seeks Judgment against Perry Trucking Company.

“This is so very sad,” John Kirk commented. “There has been so much heartache and suffering by the children and others. Our job and our duty is to recover whatever we can from the trucking company for the estate of their dear mother, money to help them with school and the many other expenses of living. Phillip Blair and John C. Kirk will be working very hard with me to see that justice is done.”
