Coal company sued for unpaid fines

PIKEVILLE — A Floyd County mining company is being sued by the federal government for its alleged failure to pay fines for violations of the Mine Act.

Viper Coal LLC was assessed $319,393 in fines for 259 citations and orders, between January 2008 and August 2011, from the Mine Safety and Health Administration. To date, the complaint alleges, the company has paid $411.92, leaving a balance of $318,981.08.

The complaint, filed Friday, further alleges Viper was sent 21 letters demanding payment of the fines, between January 2008 and August 2011.

The complaint seeks to force Viper to pay the fines, a $210 administrative fee, $7,393.17 in interest, $3,946.62 in civil penalties, $111,288.27 in other fees, and compensation of $400.
