PRESTONSBURG — A Floyd County man charged with raping a 12-year-old girl picked up a few extra charges after an outburst in court Tuesday during his preliminary hearing.
According to court records, David Jason Slone, 38, of Wayland, did not sit quietly during his preliminary hearing, and at one point jumped up and loudly called County Attorney Keith Bartley “a [expletive deleted] liar.”
“It wasn’t just what he called me,” said Bartley. “It was a very violent, threatening move he made.”
According to Bartley, he responded to Slone in kind with his own coarse verbiage, and then later apologized to the court for his inappropriate response.
“I responded the way I would have in any other setting, not as I should in a court room,” Bartley said.
Several witnesses also reported seeing Slone, upon exiting the courtroom, gesture at two potential witnesses in his rape case by pointing his finger in a manner resembling a firearm.
Judge Jimmy Marcum became a little terse himself after Slone shouted the obscenities.
“I want that man charged with disorderly conduct for interrupting the proceedings of this court,” Marcum could be heard saying during court.
Slone’s outburst came as Bartley was arguing against a bond reduction. Slone’s bond is currently set at $100,000. Bartley was informing the court that Slone had previously been convicted or charged with numerous offenses in different places and that his bond should not be lowered.
According to Bartley, his argument against a bond reduction is because Slone has previously been charged with three counts of theft by unlawful taking, third-degree burglary, two counts of criminal possession of a forged instrument, possession of marijuana, possession of drug paraphernalia, fleeing or evading police officer, two time persistent felony offender, providing false name to police officer, second-degree escape, aggravated assault, receiving stolen property, wanton endangerment, resisting arrest, and criminal sexual assault of a person under 13 years of age, which Bartley says occurred in Kalamazoo, Mich.
Bartley said that, in light of the information discovered in Slone’s background check, the $100,000 bond may not be appropriate and his office may seek to have it raised, or to see Slone held without bail. “We’re talking about a guy with a history of escape, fleeing and evading, and giving false names to people.”
According to Kentucky State Police reports, Slone was found with a gunshot wound before reportedly being taken to a Lexington hospital to treat the wound, where he was charged with first-degree rape.
Slone waived his right to a preliminary hearing for the charges of first-degree rape and persistent felony offender, but left court with additional charges, including three counts of retaliating against a participant in a legal process, second-degree disorderly conduct, menacing, and two counts of terroristic threatening. He was arraigned Wednesday on his new charges.
A date had not yet been set for his next preliminary hearing.
