Vernotzy gets treatment instead of jail

PRESTONSBURG - Dale Vernotzy, 49, of Prestonsburg, was sentenced in circuit court Friday following his plea of guilty to four counts of first-degree sexual abuse.

Most of the details in his case were sealed, as the case involved a minor who Vernotzy molested in May 2003.

Vernotzy, represented by Bernard Pafunda, was first thought to be incompetent to stand trial, but a hearing on the matter was held in February wherein Vernotzy was declared competent to stand trial by Circuit Judge John D. Caudill.

The sentencing saw Vernotzy again in front of Judge Caudill, who followed the prosecution's recommendation of five years. However, that sentence will be diverted, with Vernotzy assigned to a treament facility for the entire term.

Vernotzy will also have to complete a sex offender's program while staying at the facility, which is scheduled to be the Venture Home.
